However, there are provisions in the law and the Insurance Act which permit the recovery of compensation for the innocent accident victim. For example, when a public transit vehicle collides with another vehicle or object due to negligence, or the bus or streetcar driver is otherwise negligent in the use or operation of the bus or streetcar, the public transit driver and the driver of the other vehicle involved in the collision, as well as the owners of those vehicles, can be sued for negligence in a tort action.
